Terms of Sale

 

1. Scope

These Terms of Sale ("Terms") apply to all sales between CANNIBAL CC, operated by KERAMO ("the Seller"), and any individual or entity ("the Customer") purchasing on cannibalcc.com ("the Site").

By placing an order, the Customer acknowledges having read and accepted these Terms without reservation.

3. Products

The Site offers cycling lifestyle apparel (t-shirts, hoodies, caps, accessories). Each product has a detailed description on its product page, including materials, sizes, and price.

All products are printed to order (Print-on-Demand) by our manufacturing partner Printful, based in Riga, Latvia.

Product photos and illustrations are indicative. Slight variations in colour (screen vs actual product) may occur due to display devices.

4. Prices

Prices are displayed in euros, including all taxes (VAT) for orders shipped within the European Union.

For orders outside the EU, prices exclude local taxes and customs duties, which remain the Customer's responsibility.

Shipping costs are calculated based on the delivery zone and shown before order validation. See the Shipping page for details.

The Seller reserves the right to modify prices at any time. However, products are invoiced at the price applicable when the order is validated.

5. Order

To place an order, the Customer:

  1. Selects products and adds them to cart
  2. Reviews cart contents
  3. Enters contact details and delivery address
  4. Chooses a shipping method
  5. Completes secure payment
  6. Validates the order

The Customer receives a confirmation email summarizing the order within minutes.

The Seller reserves the right to refuse or cancel any order for legitimate reasons (production issue, manifest pricing error, prior dispute, etc.). In case of refusal, the Customer is notified by email and refunded in full if payment was processed.

6. Payment

Payment is made exclusively online at order validation, via:

  • Credit/debit card (Visa, Mastercard, American Express)
  • Apple Pay
  • Google Pay
  • PayPal

Payments are secured by Shopify Payments. No banking data is stored by the Seller.

The order is only validated and processed after effective payment confirmation.

7. Delivery

Products are shipped from Riga, Latvia (European Union).

Delivery times (production 3-5 days + shipping):

  • France: 5 to 10 business days
  • Rest of EU: 5 to 12 business days
  • UK, Switzerland, Norway: 7 to 14 business days
  • North America: 10 to 15 business days
  • Rest of world: 15 to 25 business days

These times are indicative. In case of significant delay (beyond 30 days in France or 45 days elsewhere), the Customer may request cancellation and full refund.

Delivery is deemed completed when the parcel is handed to the Customer by the carrier. The Customer is responsible for checking the parcel condition upon receipt.

8. Right of Withdrawal

Pursuant to article L.221-18 of the French Consumer Code, the Customer has 14 days from the receipt of their order to exercise their right of withdrawal, without justification.

To exercise this right, the Customer must notify the Seller by email at cannibalcc@gmail.com, indicating the order number.

Products must be returned in original condition, unworn, unwashed, with tags intact, within 14 days of withdrawal notification. Return shipping is the Customer's responsibility, except for defective or non-conforming products.

Refunds are processed within 14 days of return receipt, on the original payment method.

⚠️ Exception: per article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to Customer specifications or clearly personalized. However, since our products are standard models (not personalized), the right of withdrawal applies.

9. Warranties

Products benefit from legal warranties:

  • Conformity warranty (articles L.217-3 et seq. of the French Consumer Code): 2 years from delivery
  • Warranty against hidden defects (articles 1641 et seq. of the French Civil Code): 2 years from defect discovery

For non-conforming or defective products, the Customer must notify the Seller within 7 days of receipt, by email to cannibalcc@gmail.com, with photo evidence. The Seller will arrange replacement or full refund, return shipping at our expense.

10. Personal Data

Personal data collected during ordering is used solely for order processing and customer communication. Data is retained per legal durations.

The Customer has rights of access, rectification, deletion, and objection to data processing, per the General Data Protection Regulation (GDPR).

11. Intellectual Property

All Site elements (texts, images, logos, brands, designs, photographs) are the exclusive property of CANNIBAL CC / KERAMO or their rightful owners. Any reproduction, representation, modification, or exploitation without prior written permission is prohibited and constitutes infringement.

12. Liability

The Seller cannot be held liable for indirect damages suffered by the Customer (loss of use, loss of profit, etc.).

The Seller's liability is limited to the amount of the relevant order.

The Seller cannot be held liable in case of force majeure (natural disaster, strike, carrier failure, etc.) resulting in delay or impossibility of delivery.

13. Mediation

Per article L.612-1 of the French Consumer Code, the Customer may use a consumer mediator free of charge for unresolved disputes.

14. Applicable Law and Jurisdiction

These Terms are governed by French law.

For unresolved disputes, French courts have exclusive jurisdiction. For consumer Customers, jurisdiction lies with the defendant's domicile or the place of delivery.

Étape 2 — Compléter les infos KERAMO

Avant de publier, remplace dans le texte :
